1. Introduction

Welcome to blueberry. (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the blueberry. platform, website, and related services (the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.

2. The Service

blueberry. is an analytics workspace. You upload your files (Excel and CSV), blueberry. investigates the schema, you confirm the configuration, and you get a workspace where you track your numbers, ask questions in plain language, and edit interactive dashboards built from your data.

We may add, modify, or remove features at any time. We'll do our best to communicate significant changes in advance.

3. Account Registration

To use the Service, you must:

• Be at least 18 years old, or have permission from a parent or legal guardian.
• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and confidential.
• Notify us immediately of any unauthorised access to your account.

You are responsible for all activity that happens under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload data you don't have the legal right to process or share.
• Upload content that is malicious, infringing, defamatory, or harmful to others.
• Attempt to reverse-engineer, decompile, or circumvent the Service's security.
• Use the Service to build a competing product.
• Resell or sublicense the Service without our written permission.
• Overload, disrupt, or interfere with our infrastructure.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Your Data

You retain full ownership of any data you upload to blueberry. (“Your Content”). By uploading, you grant us a limited licence to store, process, and display Your Content solely to provide the Service to you.

We do not sell Your Content, and we do not use it to train AI models. For details on how we handle data, see our Privacy Policy.

You are responsible for ensuring you have the legal right to upload and process the data you bring to the Service, including any personal data of third parties.

6. Subscriptions and Billing

Some features of the Service require a paid subscription. By subscribing, you agree to pay the fees listed at the time of purchase.

• Billing cycle: subscriptions renew automatically at the end of each billing period unless cancelled.
• Payment processing: handled by Stripe. We never see or store your card details.
• Price changes: we may adjust pricing with reasonable advance notice. Changes apply to the next billing cycle.
• Refunds: fees are generally non-refundable, except where required by law.

7. Free Plan

We offer a Free plan that includes a set of features and usage limits (such as one dashboard, limited blueberries (AI credits), and a capped file size). No credit card is required to start. You may upgrade to a paid plan at any time, and you will never be charged without explicit consent.

8. Cancellation and Termination

You may cancel your subscription or close your account at any time from your account settings or by contacting us.

We may suspend or terminate your access to the Service if:

• You violate these Terms.
• Your payment is overdue or fails repeatedly.
• We're required to do so by law.
• We discontinue the Service (with reasonable notice where possible).

On termination, your right to access the Service ends immediately. You can request export or deletion of your data before termination — see our Privacy Policy.

9. Intellectual Property

The blueberry. platform, including its software, design, branding, and content (excluding Your Content), is owned by blueberry. and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Disclaimers

The Service is provided “as is” and “as available”. While we work hard to keep things running smoothly, we don't guarantee:

• That the Service will always be available, uninterrupted, or error-free.
• That blueberry.'s suggestions, schemas, or analyses will always be accurate.
• That the Service will meet every specific need or use case.

You are responsible for reviewing blueberry.'s suggestions and confirming the accuracy of dashboards built from your data before relying on them for business decisions.

11. Limitation of Liability

To the maximum extent permitted by law, blueberry. and its team are not liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or 100 EUR, whichever is greater.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the “Last updated” date and notify active users by email or in-app message if changes are significant. Continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of Portugal and the European Union. Any disputes will be resolved by the competent courts in Portugal, unless mandatory consumer protection law gives you the right to bring proceedings elsewhere.
